Terms and Conditions

§ 1 Scope and operator

These Terms and Conditions apply to use of the VapoMarkt platform, operated by:

By registering for or using the platform, the user accepts these Terms and Conditions in full and irrevocably.

§ 2 Description of services

VapoMarkt is an online marketplace that enables registered users to offer used dry herb vaporizers for sale or to purchase them. The operator merely provides the technical infrastructure and is not a party to purchase contracts concluded between users.

§ 3 Registration and user account

Use of the platform requires registration with a valid email address. The user is obliged to provide truthful information and keep their login details confidential. The user is solely responsible for all activity under their account.

§ 4 Creating listings

Users may create listings for used vaporizers. The user warrants that all information in the listing is truthful and that they are entitled to sell the item offered. The operator reserves the right to delete listings without stating reasons.

§ 5 Prohibited content

Publishing illegal, offensive, insulting or rights-infringing content is prohibited. Violations may result in the user account being suspended immediately.

§ 6 Purchase contracts between users

Purchase contracts are concluded exclusively between the respective users. The operator is not a party to the contract and provides no warranty or guarantee for the items offered. All claims arising from the purchase contract must be asserted exclusively against the respective contracting party.

§ 7 Exclusion of liability

The operator excludes all liability to the extent permitted by law. This includes in particular, but is not limited to:

• Damage arising from transactions between users
• Damage caused by incorrect or misleading information in listings
• Damage caused by fraud or deception by other users
• Loss of data or technical faults
• Loss of profit or other indirect damage
• Damage arising from use of the platform or inability to use it

The user uses the platform at their own risk. The operator accepts no responsibility for the quality, safety or legality of the items offered.

§ 8 Waiver of claims

By using this platform, the user irrevocably waives all claims against the operator that arise from use of the platform or could be connected with it.

This waiver covers all present and future claims of any kind and on any legal basis, including claims for damages, claims based on unjust enrichment and contractual claims.

§ 9 Indemnification

The user indemnifies the operator against all third-party claims asserted due to infringements of rights by the user. The user bears all costs incurred by the operator, including reasonable legal defence costs.

§ 10 Suspension and termination

The operator may suspend or delete user accounts at any time without stating reasons. There is no entitlement to use the platform.

§ 11 Final provisions

German law applies. If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions remains unaffected. The operator reserves the right to amend these Terms and Conditions at any time. The current version can be viewed on the platform.
